These Terms and Conditions (“Terms”) govern your use of the website www.provincetownfilm.org and all purchases of tickets, passes, and merchandise made through our website, at our Waters Edge Cinema box office, or at festival venues operated by Provincetown Film Society (“PFS,” “We,” “Us,” or “Our”), a Massachusetts nonprofit 501(c)(3) organization.
Please read these Terms carefully before making any purchase or using our website. By using our website or purchasing any product or ticket, you agree to be bound by these Terms. If you do not agree, please do not use our website or make a purchase.
We reserve the right to update or modify these Terms at any time. Changes take effect upon posting to this page. Your continued use of the website or services after changes are posted constitutes your acceptance of the revised Terms.
1. About Provincetown Film Society
PFS is a registered 501(c)(3) nonprofit organization dedicated to supporting independent film and the annual Provincetown International Film Festival and year-round Waters Edge Cinema. Our principal office is located at 237 Commercial Street, 5th Floor, Provincetown, MA 02657.
As a nonprofit, all proceeds from ticket sales, pass sales, and merchandise sales support our mission to celebrate and advance the art of independent cinema.
2. Use of Our Website
Eligibility
You must be at least 18 years of age to make purchases on our website. By using the website and completing a purchase, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
Permitted Use
You may use our website for lawful purposes only. You agree not to:
- Use the website in any way that violates applicable federal, state, or local law
- Attempt to gain unauthorized access to any portion of our website or systems
- Use automated tools, bots, or scripts to access, scrape, or interfere with our website
- Purchase tickets or passes for the purpose of unauthorized resale or scalping
- Transmit any harmful, offensive, or disruptive content through our website
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
We reserve the right to suspend or terminate access to our website for any user who violates these Terms.
Intellectual Property
All content on this website — including text, images, logos, graphics, video, and programming — is the property of PFS or its licensors and is protected by U.S. and international copyright and trademark law. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written permission.
Film content screened at the Provincetown International Film Festival and the Waters Edge Cinema remains the intellectual property of the respective filmmakers and rights holders. Recording, photographing, or reproducing any film or performance in any format is strictly prohibited.
3. Accounts and Registration
To purchase tickets or merchandise online, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and not share it with others
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to terminate accounts that contain inaccurate information or that violate these Terms.
4. Cinema and Festival Tickets and Passes
Purchase and Confirmation
All ticket and pass purchases are subject to availability. A purchase is complete when you receive an order confirmation email from us. That confirmation constitutes our acceptance of your order and forms a binding agreement between you and PFS.
If you do not receive a confirmation email within 24 hours of purchase, please check your spam folder and then contact us at [email protected] before assuming your order was not processed.
Ticket Types
We offer the following categories of ticketing products for festival and cinema screenings and events, which may vary from festival year to festival year:
- Single film tickets — admission to one specific scheduled screening
- Day passes — admission to available screenings on a specified festival day
- Full festival passes — access to available screenings throughout the festival run, subject to capacity and any applicable reservation requirements
- Special event tickets — admission to galas, panels, receptions, filmmaker Q&As, and other non-screening events, which may carry separate pricing and terms
- Comp and complimentary tickets — issued at our discretion; no cash value and non-transferable unless otherwise stated
Purchase Limits
To ensure broad public access to the festival, we reserve the right to impose purchase limits per person, per screening, or per pass type. Any applicable limits will be stated at the time of purchase.
Ticket Delivery
Tickets and passes are delivered electronically to the email address provided at checkout. It is your responsibility to ensure your email address is entered correctly. We are not responsible for tickets sent to an incorrect email address provided by you.
Electronic tickets must be presented at the venue — either printed or displayed on a mobile device — with a scannable QR or barcode. Damaged, illegible, or duplicated tickets may be refused at the venue.
Admission Policy
- Ticket holders and passholders must arrive and be in their seats or in the appropriate queue at least 15 minutes before the published start time of their screening or event to be guaranteed entry.
- Fifteen minutes before a screening begins, PFS reserves the right to release unclaimed seats to standby attendees. Ticket holders who arrive after this time are not guaranteed a seat and are not entitled to a refund.
- All attendees are subject to capacity limits at each venue. Capacity restrictions are enforced at the sole discretion of PFS staff and venue personnel.
- PFS reserves the right to refuse entry to or remove any attendee who violates these Terms, our Code of Conduct in Section 9 below, or the policies of any festival venue.
Waitlists
For sold-out screenings, a standby or waitlist line may be available at the venue. Joining a waitlist does not guarantee admission. Waitlist admission is granted at the discretion of box office and venue staff based on available capacity at showtime.
Program Changes
All festival and cinema programming is subject to change. Films, screening times, venues, and special events may be added, removed, rescheduled, or substituted without prior notice due to circumstances beyond our control, including but not limited to technical failures, filmmaker requests, rights issues, or force majeure events. We will make reasonable efforts to notify ticket holders of material scheduling changes via email and on our website.
A program change, including the substitution or cancellation of a specific film, does not entitle the ticket holder to a refund, except as provided in Section 6 below.
Prohibited Conduct at Screenings and Events
By attending any PFS screening or event, you agree to the following:
- No recording: The unauthorized recording, photography, videography, or live streaming of any film, performance, or event is strictly prohibited and constitutes copyright infringement under U.S. and international law.
- No duplication or distribution: You may not copy, rebroadcast, distribute, or share any film or portion thereof in any medium.
- Silence and courtesy: Mobile phones must be silenced during screenings. Disruptive behavior will result in removal without a refund.
- Alcohol and conduct: PFS events may serve alcohol. You must be 21 years of age to consume alcohol at any PFS event. Intoxicated or disruptive individuals will be removed without a refund.
5. Merchandise Orders
Online Store
When you place a merchandise order through our online store (t-shirts, hats, and other items), you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is confirmed when you receive an order confirmation email.
Pricing
All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price displayed at the time of checkout. Applicable sales tax will be added based on your shipping address.
Availability
All merchandise is subject to availability. If an item you ordered is out of stock after your order is placed, we will notify you and offer a replacement, store credit, or full refund.
Shipping
We ship merchandise within the continental United States. Shipping timelines and costs are displayed at checkout. We are not responsible for delays caused by shipping carriers, weather events, customs, or other circumstances beyond our control.
Once your order is shipped, you will receive a confirmation email with tracking information. Risk of loss and title for merchandise passes to you upon delivery to the carrier.
In-Person Merchandise Sales
Merchandise is also available for purchase at our cinema location and at festival venue merchandise tables. In-person sales are final at the point of purchase. Exchanges for size or defect may be made at the point of sale or by contacting us within 14 days of purchase with proof of purchase.
6. Refund and Exchange Policy
Tickets and Passes
All ticket and pass sales are generally final. We do not offer refunds or exchanges after purchase, except in the following circumstances:
- Festival cancellation: If the festival is cancelled in its entirety due to circumstances beyond our control (including but not limited to natural disaster, public health emergency, or force majeure), we will issue refunds or festival credits at our discretion.
- Individual screening cancellation: If a specific screening for which you hold a single-film ticket is cancelled and not rescheduled, we will offer a credit toward another screening or a refund of that ticket’s face value.
- Duplicate charges: If you were charged more than once for the same order due to a technical error, please contact us and we will correct the error promptly.
We do not issue refunds for:
- Failure to attend a screening (including due to late arrival)
- Program changes, film substitutions, or rescheduling
- Change of personal plans
- Inclement weather (unless the event itself is cancelled)
Merchandise
Merchandise purchased online may be returned or exchanged within 30 days of delivery provided the item is unworn, unwashed, and in its original condition with tags attached. To initiate a return or exchange, please contact [email protected] with your order number and reason for return. Return shipping costs are your responsibility unless the item is defective or we made an error in fulfilling your order.
Refunds for eligible returns will be issued to the original payment method within 5–10 business days of our receiving the returned item.
7. Payment
All purchases are processed through Stripe, our PCI DSS-compliant payment processor. By completing a purchase, you authorize us to charge the payment method you provide for the total amount of your order, including any applicable taxes and fees.
You represent that you are the authorized holder of the payment method used. We are not responsible for any fees your bank or card issuer may charge in connection with your purchase.
In the event of a failed payment, your order will not be confirmed. If you believe a payment error has occurred, please contact us at [email protected].
We do not store your full credit card number. All payment card data is handled exclusively by Stripe. Please review Stripe’s Privacy Policy at stripe.com/privacy for information on how they handle your payment data.
8. Nonprofit Status and Tax Deductibility
Provincetown Film Society is a 501(c)(3) tax-exempt nonprofit organization. Purchases of tickets and merchandise are not tax-deductible as charitable contributions, as they represent payment for goods and services received.
Donations made separately to PFS, beyond the fair market value of any goods or services received in return, may be tax-deductible to the extent permitted by law. Donors will receive a written acknowledgment as required by the IRS for contributions of $250 or more.

9. Code of Conduct
PFS is dedicated to providing a safe, inclusive, and welcoming experience for all attendees, staff, filmmakers, volunteers, and guests — regardless of gender, gender identity and expression, age, sexual orientation, disability, physical appearance, race, ethnicity, national origin, or religion.
We have a zero-tolerance policy for harassment, discrimination, intimidation, or threatening behavior of any kind at any PFS screening, event or venue. Violations of this Code of Conduct will result in immediate removal from the event without a refund, and may result in a ban from future PFS events.

10. Assumption of Risk and Liability
Attending Events
Attendance at PFS screenings and events involves inherent risks associated with gathering in public spaces, including but not limited to exposure to communicable illness, injury, theft, or property damage. By purchasing a ticket or pass and attending any PFS festival or cinema screening or event, you acknowledge these risks and voluntarily assume them.
Limitation of Liability
To the fullest extent permitted by applicable law, PFS, its officers, directors, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, purchase of tickets or merchandise, or attendance at any PFS festival or cinema screening or event, including but not limited to personal injury, loss of data, or loss of enjoyment.
Our total liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the amount you paid to us for the specific ticket, pass, or merchandise item giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless PFS and its officers, directors, employees, agents and volunteers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your use of our website, or your conduct at any PFS festival or cinema screening or event.
11. Force Majeure
PFS shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to natural disasters, fire, severe weather, pandemic, public health orders, power outages, labor disputes, acts of government, or any other event beyond our reasonable control. In such circumstances, PFS will make reasonable efforts to notify affected ticket holders and determine an appropriate remedy, which may include rescheduling, credits, or refunds at our discretion.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Barnstable County, Massachusetts, and you consent to the exclusive jurisdiction of those courts.
Before initiating any legal action, we encourage you to contact us at [email protected] to attempt to resolve the dispute informally. We will make good faith efforts to resolve any concerns promptly.
13. Accessibility
PFS is committed to making our events, website, and venue accessible to all attendees. If you require accessibility accommodations — including but not limited to wheelchair access, assistive listening devices, or large-print materials — please contact us at [email protected] in advance of your planned attendance so we may make appropriate arrangements.
14. Links to Third-Party Sites
Our website may contain links to third-party websites or services, including our ticketing platform, social media channels, and partner organizations. These links are provided for your convenience only. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is governed by their own terms and policies.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms, without affecting the validity or enforceability of the remaining provisions.
16. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented at the time of purchase, constitute the entire agreement between you and PFS with respect to your use of our website and purchase of tickets and merchandise. These Terms supersede all prior agreements, representations, or understandings between us on those subjects.
